Jury Awards $400,000 to Hopatcong Man

"NEWTON - A Hopatcong man who sued three drunken borough men for assaulting and kicking him in the head was awarded $400,000 by an eight-member Sussex County jury.

Brett Turkington, 33, sued three men - one who tackled him and put him in a headlock, another who argued with his girlfriend and a third who kicked him in the head on May 8, 1998 in Hopatcong.

Succasunna Attorney, John E. Ursin, who represented Turkington, said that the Sussex County Prosecutor's Office declined to prosecute the defendants and remanded the case to municipal court. Pam Prather, a spokesperson for the prosecutor's office, said the prosecutor could not be reached for comment. The municipal matter was later dropped because all of the parties filed chanrges and had different versions of the story, Ursin said."
